WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

EARTH MOVERS NETWORK INC. (Ramsay Junction Event and Coworking Space, Harmony Health Community, Underground Foods)

IMPORTANT: THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING.

In consideration of being permitted to use the facilities, services, or attend any events, classes, or functions at Ramsay Junction Event and Coworking Space, Harmony Health Community, or Underground Foods, all managed by Earth Movers Network Inc. (hereafter referred to as "“the Business”"), located at 914 19th Ave SE, Calgary, Alberta Canada, T2G 1L8, including any satellite locations owned by the Business, the undersigned acknowledges, understands, and agrees to the following:

1. Assumption of Risk

I acknowledge that my participation in or attendance at any activity, event, or use of the facilities offered by Ramsay Junction Event and Coworking Space, Harmony Health Community, or Underground Foods involves inherent risks, including but not limited to personal injury, illness, or property damage. I voluntarily assume full responsibility for any risk of injury, illness, death, or property damage arising out of or related to my use of the facilities, services, or participation in any event.

I further acknowledge that the Business may not be fully aware of all activities or services offered by third-party clients who book the space for their own purposes. These activities, which may include but are not limited to fitness training, therapy, counseling, beauty treatments, food services, and events with alcohol, are outside of the direct oversight of the Business.

2. Release and Waiver of Liability

I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless Ramsay Junction Event and Coworking Space, Harmony Health Community, Underground Foods, Earth Movers Network Inc., and any of their owners, directors, officers, employees, agents, registered and beneficial owners of this real estate, shareholders, and representatives from any and all claims, liabilities, demands, causes of action, or damages, including but not limited to those related to injury, illness, or property damage, arising out of or in connection with my participation in any activity, event, or use of the facilities.

This waiver extends to any negligence on the part of the Business, including negligent supervision, maintenance, or the acts of third parties using the space.

3. Indemnity

I agree to indemnify, hold harmless, and defend hold harmless Ramsay Junction Event and Coworking Space, Harmony Health Community, Underground Foods, and Earth Movers Network Inc. as innocent from any claims, lawsuits, demands, costs, and expenses, including legal fees, arising out of my actions or the actions of third parties for whom I am responsible, while participating in any activity or using the facilities.

This indemnity extends to any third-party clients who may rent the space and offer their own services (e.g., therapy, beauty treatments, coaching, food distribution), and any harm caused by their services or activities. This includes, but is not limited to, harm to the client, harm to the provider, and/or harm to bystanders.

I agree to take full responsibility for any and all legal fees, should the circumstance arise, and defend the Business as innocent in regards to the case.

4. Liquor and Alcohol Responsibility

If I am hosting or attending an event where alcohol is served, I acknowledge that it is my responsibility, or that of the event organizer, to secure any necessary permits, licenses, or insurance as required by Alberta law, including but not limited to compliance with the Alberta Gaming, Liquor, and Cannabis Commission (AGLC) requirements. The Business bears no responsibility for any incidents arising from the distribution, consumption, or service of alcohol by event hosts or attendees.

I understand that the Business requires the proper permits, licenses, or insurance in order to allow alcohol to be served at an event, and that this information must be provided to the Business twenty-four (24) hours before the outset of the event.

5. Satellite Location Waiver

This waiver applies equally to all activities, services, and events held at any satellite locations of the Business, owned by Earth Movers Network Inc. All conditions and responsibilities outlined herein extend to these locations.

6. Oxygen Relaxation Therapy (Hyperbaric Therapy)

I understand that oxygen relaxation therapy, also known as hyperbaric therapy, carries unique risks. I assume full responsibility for any injury, illness, or other consequences related to these treatments. I confirm that I have provided the Business with accurate medical information and consulted with a medical professional before participating in any such treatment. I release Ramsay Junction Event and Coworking Space, Harmony Health Community, and Earth Movers Network Inc. from any liability for medical complications or issues arising from my participation in these therapies.

7. Fitness, Beauty, Personal Services, Psychological Therapy, Coaching and Consulting, and Food Services Activities

I acknowledge that participation in the functions and services provided by the Business, which include, but are not limited to fitness classes, health and wellness consultation and treatment services, beauty and/or personal care treatments, psychological therapy, coaching andor consulting services, business/networking/workshopping/informational events, and/or any food services offered by Ramsay Junction Event and Coworking Space, Harmony Health Community, and Earth Movers Network Inc. carries certain risks, including physical injury, emotional distress, or illness. I voluntarily assume these and all other risks and waive any claims against the Business for injuries, damages, or complications arising from these services.

8. Minors at Events

I understand that minors may attend private events when invited by the client who booked the event, and I assume responsibility for any minors in my care. I acknowledge that minors may not book events. As the parent or guardian of any minor in attendance, I release the Business from any liability concerning the minor’s participation in any activities or events.

9. Photography and Media

I understand that events and activities held at the Business may be photographed or recorded for promotional purposes, and I grant permission for my likeness to be used by the Business without compensation.

10. Acknowledgment of Understanding:

By checking the box in the contact form, I confirm that I have read this waiver, fully understand its terms, and agree to it voluntarily with full awareness of its legal implications.
